Detentions and arrests seem similar, but in fact are vastly different actions. If someone is detained, they are only held for a brief period of time for questioning. For example, Officer John approaches Ben who was acting suspiciously. Officer John asks Ben a few questions but does not arrest him for further questioning. Ben is free to walk away. Ben was briefly detained.

During an arrest, a person would be taken into custody with handcuffs and would be read their Miranda Rights. The arrestee would have to post bail (if he or she can afford it) and then appear before a judge. In this case, if Ben asked Officer John if he was free to leave and Officer John said no and put him in handcuffs, Ben was arrested. Officer John would need to have probable cause to arrest Ben.

Posting bail is not an option for detained persons, as detained persons can leave.
